A former traffic cop is at war with Wyndham council over what he says are incorrect parking fines.
Wyndham Vale resident Graeme Lee is outraged over two parking fines he’s received for parking along the gravel shoulder of the road across from his Ballan Road property.
According to Mr Lee, the first fine was waived when he pointed out to the council that parking on the shoulder of a road was not an offence.
He was shocked to receive a second fine, which was later downgraded to an official warning.
Mr Lee, who was a traffic cop for 35 years, said the council argued that he was illegally parking on a dividing strip, not a shoulder.
Instead of accepting the warning, Mr Lee has opted to take the matter to court to settle the dispute once and for all.
He has vowed to continue to park on the shoulder of the road in the interim.
“There’s now been two tickets issued, and they’ve both been withdrawn,” he said. “To me, the case is open and shut.
“What I want to do is take it court, put both sides of the story to the magistrate, and get a response … in regards to the legal aspect of it.
“If I believe the magistrate is wrong, I’m going to appeal that to the County Court … so that it then becomes case law.”
Mr Lee said it was ironic that he was being fined for parking along the shoulder when he had images of council vehicles doing the same thing.
Mr Lee also snapped a council vehicle partially blocking a neighbour’s driveway.
The council said it could not comment on the matter as it was destined for court.
